Some may think that failing to use a turn signal or attempting an improper lane change are minor traffic violations, but these actions can have severe repercussions if they cause motor vehicle accidents (MVAs). Suppose you’ve been injured in a car accident because someone didn’t use their turn signal or passed a vehicle in an unsafe manner. You may be entitled to damages to compensate for your suffering and accident-related costs.

Understanding Traffic Laws And Signaling Regulations

NRS 484B.400 requires drivers to use the right lane for right-hand turns and details the correct position for vehicles turning left. Per NRS 484B.417, drivers must use their signal indicator lights to indicate their intent to turn or change lanes. Alternatively, they may use hand signals, described in NRS 484B.420, to communicate their intent to turn.

Since drivers can use hand signals to communicate their intent, they cannot excuse their failure to signal by claiming their signal indicator lights didn’t work.

Drivers must also follow through when they indicate they plan to turn or when they’re in a lane that requires them to turn. Failure to obey a turn signal violates Nevada traffic laws.

    Passing Regulations

NRS 484B.203 and NRS 484B.207 outline the state’s requirements for drivers when passing another vehicle. In addition to signaling when intending to turn, drivers must signal when changing lanes to pass vehicles.

    Due Care And Attention

Drivers must exercise due care and attention while driving and respond appropriately to changes in road conditions. For example, NRS 484B.270 requires drivers to use care when passing bicycles and scooters to prevent harm.

Drivers must yield to bicyclists, people riding scooters, and pedestrians when required. Suppose a driver signals their intent to turn, but pedestrians are crossing the road at a designated crosswalk. The driver must yield until the crosswalk is clear.

    Liability And Legal Consequences

Drivers can receive tickets when they fail to signal or pass a vehicle unsafely. They may face various penalties, including license points. If they accumulate too many points, their driver’s license is suspended.

    Misdemeanor Infractions

These infractions are typically misdemeanors. The legal consequences can include the following:

    • Community service
    • Fines
    • Jail sentence of 365 days or less
    • Probation

    Pedestrian And Work Zones

Additional consequences may be imposed if the driver violates these regulations in a designated pedestrian safety zone or a work zone. Additional consequences can include any of the following:

    • Fines of up to $1,000
    • Six months of incarceration
    • Up to 120 hours of community service

    Felony Violations

Suppose the driver causes a person’s death in a car accident because they failed to use their turn signal or comply with other traffic regulations. In that case, they can be charged with vehicular homicide.

    Defending Your Rights

Taking appropriate steps after an accident increases the likelihood of receiving the compensation you deserve.

Steps To Take At Accident Scene

Comply with all requirements after an accident, including the following:

    • Check for injuries: Check the condition of passengers and other drivers
    • Call authorities: Call 911 to report the accident
    • Exchange information: Give other drivers involved in the crash your name, contact information, and insurance information. You should receive the same information from them. Ask the police for this information if a driver refuses to share it.
    • Seek medical care: Medical professionals should examine you to ensure you identify accident injuries promptly
    • Document the scene: Make notes, record the names and contact information of witnesses, and take photos or videos of the scene to preserve the details
    • Call an attorney: Call a car accident attorney for a free consultation from the accident scene. The attorney will explain what you are and are not required to do and ensure you understand how to protect your legal rights.

    Right To Compensation

You have the right to seek reimbursement for accident-related costs and compensation for the psychological toll and personal impact you’ve experienced because a driver failed to comply with Nevada’s traffic regulations. You may be entitled to the following:

    • Economic damages: Monetary or economic damages are reimbursements for accident-related expenses, such as childcare, lost income, medical bills, and property damage
    • Non-economic damages: Non-monetary or non-economic damages compensate for accident-related mental health issues, such as anxiety, depression, phobias, and post-traumatic stress disorder (PTSD). Non-monetary damages can also compensate for pain and suffering, loss of intimacy, and how the accident has adversely impacted their quality of life.
    • Punitive damages: Suppose you can prove the at-fault driver was guilty of gross negligence and their reckless disregard for the well-being of others caused your injuries. In that case, the court may award punitive damages.

Adam S. Kutner reviews and testimonials

“We were in a car accident – we were coming off of the interstate and were waiting – yielding at the exit and a car sped through the exit and smacked us in the rear.

It was definitely scary especially because we had our baby in the car. My husband and I and our baby in the back seat. We definitely – immediately went back in and checked on her to make sure she was okay.

We definitely had back pains my daughter had headaches. She kept holding her head and crying. It was pretty bad. I remember seeing a couple billboards and a friend of mine did say they had a pleasant experience with Adam Kutner, so we called them right up. They definitely were thorough, and you could tell just by talking to the people in the office that they genuinely cared about their clients.

They contacted us saying you know, explain the process on how the settlement gets done and about a week after that happened we had our settlement which was great and in my opinion Adam S. Kutner is the best attorney in Las Vegas.”
